| Precedent established | It cannot be said that the Prime Minister has a greater responsibility for the right to live in a healthy environment and its protection than the petitioners, based on an environmental assessment. Therefore, the petitioners do not have the right to file a petition on this matter. In the context of the implementation of the Nepal Vehicle Pollution Standards, 2056 (1999) and to prevent pollution from vehicles and protect the deteriorated environment, it is advisable not to rely solely on the pollution standards certification provided by vehicle manufacturers from other countries. Instead, it is important to establish appropriate mechanisms to verify whether imported vehicles meet the specified standards, including Type Approval and Conformity of Production. Therefore, a directive will be issued in the name of the Ministry of Population and Environment to ensure the necessary arrangements are made for such verification. |
